Welcome to this website, hereinafter referred to as the “The Alest Hotel Site" and / or "WEB”. Your use of this Site is expressly conditioned on your acceptance of these Terms and Conditions. "The Alest Hotel WEB" reserves the right to add to or modify the Terms and Conditions at any time. All the terms added or modified will take effect when they are updated. The continued use of this site even after the publication of changes made to the Terms and Conditions will mean that you accept said changes. 1.- ABOUT “THE ALEST HOTEL”
These Terms and Conditions regulate the use and purchases made through the various means made available to the User by “THE ALEST HOTEL”, including the Website, as this term is defined in Chapter 2 of these Terms and Conditions, which is owned by MOPELU, S.A de C.V. (hereinafter "THE ALEST HOTEL"), which has its address at Eugenio Sue number 45, colonia Polanco V Sección, alcaldía Miguel Hidalgo, C.P. 11560, in Mexico City and has the following telephone number 55 8094 4715, which we invite you to contact in case you have any questions, comments or claims.
MOPELU, S.A. de C.V. is a company duly constituted under Mexican laws, its Federal Taxpayers Registry is MOP18022474A and it has the financial capacity, experience and resources necessary to acquire hotel occupancy for the benefit of the User, as well as the other benefits indicated in these Terms and Conditions.
"THE ALEST HOTEL" reserves the right to modify the content and design of the Website at its sole discretion and without any liability, as well as the Terms and Conditions that it deems necessary or convenient at any time and without the need for notice or prior notification to Users of the Site with the understanding that transactions that have been paid in full by the User will be honored at all times. We invite you to continuously verify and consult these Terms and Conditions in order to be aware of such changes or modifications.
The User understands and accepts that "THE ALEST HOTEL" may contract any third party designated by it to administer the "THE ALEST HOTEL" Plan and provide services to the Users so that they can exchange some benefits provided by "THE ALEST HOTEL" for Lodging or other Benefits.
2.- ABOUT “THE USER”
You, the User of the Website, declare that you are a natural person, of legal age, in full use and enjoyment of your powers and rights, without restriction or impediment to being bound in accordance with the provisions of these Terms and Conditions.
You declare that the personal identification data that you have provided to “THE ALEST HOTEL”, its affiliates or subsidiaries on the Website and / or through any verbal or written communication, by any means or format, are true and correct, and that they are the basis for which you are bound to comply with the provisions of these Terms and Conditions.
Both when accessing and using the Site and when contracting the services offered therein, you accept each and every one of these Terms and Conditions. You understand and accept that the acceptance of these Terms and Conditions will be a prior and indispensable step to the acquisition of any service offered on the Site.
3.- DEFINITIONS
a.- Benefits: means each and every one of the services, other than Lodging, that the User may purchase at “THE ALEST HOTEL”, including without limitation food, various activities.
b.- Call Center: it is the center for information, reservation, modification, cancellation and sale of products and services, authorized for such purposes by “THE ALEST HOTEL”.
c.- Personal Consumption: means all consumption made by a User or a Guest in the Development, and that the User must personally cover as required by the Operator.
d.- Hotel Group Fees: means the totality of fees provided for in these Terms and Conditions.
e.- Modification or Cancellation Fee: means the amount payable by a User to proceed with the modification or cancellation of a Confirmed Reservation.
f.- Development: means the boutique hotel located at Eugenio Sue number 45, colonia Polanco V Sección, alcaldía Miguel Hidalgo, C.P. 11560, in Mexico City.
g.- Lodging: means the right of the User to use the Development by paying the Reservation Fee in accordance with the reservation procedure established in these Terms and Conditions. Lodging does not include any food or other services not indicated.
h.- Guest: means the person or persons designated by a User to receive Lodging, when the User is not using it, in accordance with the provisions of these Terms and Conditions.
i.- Operator: means the various people and / or society that provide Lodging in the Development and / or that provide the various services that make up the Benefits.
j.- Confirmed Reservation: means the written confirmation, issued by "THE ALEST HOTEL", either physically or electronically, which contains the definitive reservation of Lodging within the Development.
k.- Website or Site: means the set of electronic pages identified through a domain or an Internet address (including, without limitation, https://thealest.com/ , Internet address in effect on the date of the last modification of these Terms and Conditions) which is managed by "THE ALEST HOTEL" to communicate and notify information about Plans electronically, update Development information, and publish the amounts of Fees and modifications to these Terms and Conditions, as established therein.
l.- Reservation Request: means the request, made either by telephone or by electronic means, from a User to "THE ALEST HOTEL" for Lodging within the Development to take place in a room of a certain type and on a specific date.
m.- Terms and Conditions: it is the set of provisions established by "THE ALEST HOTEL" under which the relationship with the User is regulated.
n.- User: means the natural or legal person who uses the Website and contracts the services offered by "THE ALEST HOTEL" through the various means made available to them.
4.- INDUSTRIAL AND INTELLECTUAL PROPERTY. “THE ALEST HOTEL”, its subsidiaries or related companies, as well as its licensors and licensees, hold, either by themselves, or by virtue of a contract with third parties, all rights to the content and design of the Website and, especially including, but not limited to, photographs, images, texts, logos, designs, brands, trade names and data that are included within it. Such rights are protected by current legislation regarding industrial and intellectual property.
The copying, reproduction, adaptation, modification, distribution, commercialization, public communication and / or any other action that constitutes an infringement of current legislation on industrial and intellectual property, as well as the use of the contents of the Website, is completely prohibited, unless it has been previously and expressly authorized in writing by "THE ALEST HOTEL".
"THE ALEST HOTEL" advises that the mere fact of accessing and consulting the Website does not grant any license, authorization or implicit right as to the intellectual and / or industrial property rights or to any other right or property related, directly or indirectly, to the contents included in the Website.
5.- USE OF WEBSITE. Users must use the Website responsibly and for lawful purposes in accordance with these Terms and Conditions. Activities not to be carried out include, but are not limited to, the following: i) Distribute, disclose, announce or publish any information or material that degrades, discredits, embarrasses, humiliates or threatens people; ii) Abuse, defame, harass, accuse, threaten or otherwise infringe upon the rights of another; iii) Download or upload files or programs of any kind; iv) Distribute, disclose, post or publish any indecent material or information that infringes upon the rights of third parties; v) Advertise or send, or in any other way disclose confidential information, trade secrets or other exclusive, confidential and / or protected data; vi) Copy or create derivative works by displaying, distributing, licensing, performing, publishing, recreating, reproducing, selling, transferring or transmitting any information, products, services or software obtained by, from or through the Site; vii) Monitor or copy any content through any process; viii) Participate in any other conduct that is or that "THE ALEST HOTEL" considers to be in conflict with the Terms and Conditions, and; ix) In general, carry out any act contrary to current legislation, morality and proper conduct.
This Website may contain discussion groups, newsgroups, news boards, chat rooms and other services in which third parties other than "THE ALEST HOTEL" and you as a User participate. "THE ALEST HOTEL" will not be responsible for the communications or dialogues in the course of debates, forums, or chats that are organized through the Website and / or linked pages, nor will it be responsible, therefore, for any damages suffered by Users as a result of said communications or chats. "THE ALEST HOTEL" will have the power to review and monitor the communications or chats made through the Website, reserving the right to cancel any communication or chat as it sees fit or if it deems at its sole discretion that it goes against the provisions in these Terms and Conditions. The information that the User provides in such situations is public, and "THE ALEST HOTEL" does not asume any obligation of privacy in regard to it, so Users are advised not to provide personal data or private information except in cases specifically required for the purposes expressly mentioned in the respective privacy notice.
6.- INDEMNIFICATION. You acknowledge and accept that you will be responsible for indemnifying and holding harmless and releasing from liability "THE ALEST HOTEL", its affiliates, subsidiaries and / or any company related to it, for damages and losses derived from the breach of the provisions of the Terms and Conditions, as well as damages derived from or related to improper use that you make of the Website.
7.- DISCLAIMER OF WARRANTIES AND LIMITATIONS ON LIABILITY. "THE ALEST HOTEL" will do its best to make the content of the Site available at all times. However, "THE ALEST HOTEL" may at any time and without prior notice interrupt or cancel access to the Site and / or its contents without "THE ALEST HOTEL" incurring in any liability.
"THE ALEST HOTEL" in no case will be responsible for damages derived from or related to the use that the User makes of the Site and / or its contents, including, without limitation, the loss of data, information or programs, damage to computers or networks.
Third parties, other than "THE ALEST HOTEL" and you, may have access to the contents of the Site and could change or delete said content without authorization from "THE ALEST HOTEL". "THE ALEST HOTEL" informs you that in no case will it be responsible in the event that said changes, made without authorization by third parties, affect the content of the Site.
There are no further guarantees from "THE ALEST HOTEL" than those corresponding to the services provided by "THE ALEST HOTEL" in accordance with these Terms and Conditions. "THE ALEST HOTEL" does not recognize guarantees of any kind or nature that are not specified here. Any information that has not been provided by agents or employees of "THE ALEST HOTEL" or any third party authorized by it or by the Site may not create guarantees of any kind in relation to the Terms and Conditions or the Site.
The services offered on the Site are the only ones authorized by "THE ALEST HOTEL", so it will not be responsible for any other product or service offered by any third party other than "THE ALEST HOTEL".
8.- RESERVATION POLICIES.- The rates shown on the website are only valid at the time they are quoted. Rates will apply for their respective charge only in the event of the desired service being booked, otherwise these rates may vary.
A reservation is considered completed once you have a confirmation number and the corresponding charge has been applied. At the time of booking, you authorize us in writing and / or verbally to use your credit card number to make your payment, and expressly confirm that you know and accept these Terms and Conditions as well as the privacy policy of "THE ALEST HOTEL”. All reservations are subject to availability at the time of processing your request. Availability cannot be guaranteed until full payment has been received. For some reservations (duly identified before filling in your contact and credit card details), we have to verify availability directly with the reservations department before we can confirm them. "THE ALEST HOTEL" asks you for a maximum of 24 hours for such verification of availability and confirmation. In the event that for any reason you have not been able to complete your reservation on the site, by accepting our Privacy Notice, you authorize us to have a representative contact you in order to help you finalize your quote and, where appropriate, booking. In order to prevent setbacks, you must print out your corresponding Voucher and present it to the provider when requesting their service. If you wish to change or cancel your reservation, please contact a Travel Advisor as soon as possible at the telephone number indicated on your confirmation voucher. "THE ALEST HOTEL" recommends carefully reading the clause corresponding to the CANCELLATION POLICIES. Any change to a reservation is subject to availability and the re-quoting of rates. For more information, you should contact a Travel Advisor at the telephone numbers that appear on your Voucher. Every booking confirmed firmly by "THE ALEST HOTEL" provides a reservation control number which you must carry at all times.
9.- PAYMENT POLICIES.- If you have selected a debit or credit card as a form of payment, the amount corresponding to your reservation will be charged immediately to the card number that you provide for this purpose, as long as the status of your reservation shows that it is paid for and confirmed, the charge will appear on your account statement, identified by the label: "THE ALEST RESERVATION" or with an equivalent label to the Provider (paypal or others). For the payment of your reservation, we accept most debit and / or Credit cards specified at the time of your booking. If you do not have any of these debit and / or credit cards, you can send us a bank transfer, or a deposit. For more information please contact one of our Travel Advisors. Rates published on our site are quoted in various types of currencies, which are duly specified at for that moment in time. Mexican pesos will be charged in Mexican pesos. In the case of any other type of currency, the amount of the transaction will be converted to US Dollars at the exchange rate in effect on the date of the transaction. Please take into account that the amount that will appear on your credit card payment receipt may vary up to three percent due to the international fluctuations of the currency exchange rate. THE ALEST HOTEL is not responsible for such fluctuations. You acknowledge having been informed of the exchange rate fluctuation and agree to the corresponding charge in US Dollars.
It is worth mentioning that due to tax reasons invoices will be prepared after the payment has been generated or after the service(s) booked have been received.
10.- CANCELLATION POLICY.- All cancellation requests must be informed by you in writing via an e-mail to your Travel Advisor, mentioning your reservation number.
If for any reason a User wishes to modify or cancel a Confirmed Accommodation Reservation, User may request the corresponding modification or cancellation from THE ALEST HOTEL. Once the modification request has been received, THE ALEST HOTEL will proceed to carry out the procedures to confirm the availability of the new Accommodation and the costs involved in processing said modification of a Confirmed Reservation. THE ALEST HOTEL will inform the User whether or not there is availability, the Reservation Modification or Cancellation Fee and, where appropriate, other costs that said change implies.
The User must confirm to THE ALEST HOTEL whether or not the User accepts the new Confirmed Reservation or if the User keeps the previous one. In case of modification, THE ALEST HOTEL will proceed to send a new Confirmed Reservation.
The User who wishes to modify or cancel a Confirmed Reservation may do so as long as it is done at least 42 (forty-two) hours in advance of the date on which the Lodging services begin.
In the event that the User cancels User’s Confirmed Reservation within a period of less than 42 (forty-two) hours prior to the rendering of Lodging services, User will be charged for the cost of 1 (one) night's stay of User’s paid and confirmed Reservation Fee, due to late cancellation penalty.
In the event that the User does not cancel User’s Reservation before the start of the rendering of the Lodging services, and does not show up or does not make use of the Lodging services, User will not have any right to a refund of the Reservation Fee paid and THE ALEST HOTEL will have the power to fill the corresponding rooms with another guest.
THE ALEST HOTEL may modify the period of 42 (forty-two) hours established in the previous paragraphs in the event of promotions or special circumstances, or even not allow modification or cancellation of the Reservation on certain dates. THE ALEST HOTEL must notify the User of this circumstance at the time of issuance of the Confirmed Reservation.
11.- PRIVACY AND SECURITY.- You represent that you have read the PRIVACY POLICY, the terms incorporated into it, and agree that the terms of such policy are reasonable. You consent to your personal information being used by THE ALEST HOTEL and / or by its third party suppliers and distributors in accordance with the terms of THE ALEST HOTEL's Privacy Policy and for the purposes established therein.
12.- TRUE INFORMATION.- You acknowledge and accept your full obligation and responsibility to provide true and correct data regarding the ages, genders, names or surnames of both you and the other users-tourists who accompany you or who commission you to use this Site, as well as regarding complete data and information for the preparing of the itinerary and the booking of services, releasing THE ALEST HOTEL from any responsibility for itinerary changes generated by incorrectly provided data, or for any error in the data provided by you, such as in the case of ages, genders, names, surnames, dates, forms of payment, routes, airlines, schedules, classes, categories, special conditions, etc., adhering where appropriate to the cancellation clauses.
13.- COMPLIANCE WITH THE RULES AND CONDITIONS OF SERVICES.- You agree to adhere to and comply with the regulations and conditions of service established by THE ALEST HOTEL. Likewise, you must provide yourself with the passports or immigration documents required by the authorities in your country of origin and the countries of destination or transit, such as visas, health permits, vaccines and all documents required by the Customs, Air, Maritime, Airport, Federal, State, Municipal, etc. authorities, that are needed to take your trip, releasing THE ALEST HOTEL from any problem that may arise with said authorities, as well as from the loss of plane tickets, air transportation or hotel nights due to said omissions that in no case may be attributed to THE ALEST HOTEL as they are your sole responsibility. In the case of hotel reservations, you agree to sign the service contract or the corresponding registration card provided by said establishment upon arrival to the establishment.
14.- ADVANCE OR SETTLEMENT OF THE AMOUNT.- Both parties agree that advance payments or payments to settle the amount owed for services covered by these Terms and Conditions by you, as well as the use of coupons, tickets, courtesy passes, or any other document issued in your favor, implies your full acceptance of these Terms and Conditions.
15.- ADDITIONAL AGREEMENTS WITH SUPPLIERS.- THE ALEST HOTEL is relieved of any liability derived from additional agreements and those made outside of intermediation with THE ALEST HOTEL that have been made between you and other Suppliers that are direct service providers, such as air and land carriers, hotels, car rental companies, etc.
16.- TERMINATION.- THE ALEST HOTEL may terminate these Terms and Conditions and / or any of its services at any time without needing to advise of or notify about such termination, for any cause or reason, including for any inappropriate use of this site or your breach of these Terms and Conditions. However, such termination will not affect any right or obligation contracted by THE ALEST HOTEL toward you once a reservation has been confirmed.
17.- TRANSFER.- You may not transfer, subcontract, or delegate your rights, obligations or duties contracted here.
18.- DIVISIBILITY.- In the event that any judicial or administrative authority declares the nullity of any subsection, paragraph, or clause of these Terms and Conditions, the other subsections, paragraphs and clauses of this instrument will continue to be binding for the parties.
19.- TITLES.- The titles used in the Terms and Conditions are used only for your convenience and will not limit or otherwise affect the contents of the Terms and Conditions set forth herein.
20.- FULL AGREEMENT.- These Terms and Conditions, which are included here, or to which reference is made, constitute the full and complete agreement between the parties in regard to the object established here, and supersedes any previous agreement or contract made between the parties (whether oral or written) that refers to the same object, and will not be amended or modified except in writing or by making such amendments or modifications available on this site.
21.- INDIVISIBILITY. The User declares to have read these Terms and Conditions, and acknowledges that they contain what is the full, complete and express will of the User and THE ALEST HOTEL to carry out all the acts referred to in these Terms and Conditions, therefore the User acknowledges that the User has not received any letter or document from THE ALEST HOTEL that contains any term or condition other than what is established in these Terms and Conditions.
22.- MODIFICATIONS TO THESE TERMS AND CONDITIONS. These Terms and Conditions may be unilaterally modified by THE ALEST HOTEL, as long as Users are informed of said modifications through the Website or through the procedures established for that purpose and as long as they do not negatively affect the rights granted to Users that have made transactions paid in full.
All modifications to these Terms and Conditions will be notified to Users through notices posted on the Website, indicating the date on which the modifications will come into effect.
23.- JURISDICTION AND APPLICABLE LAW.
To resolve any controversy or conflict arising from these Terms and Conditions, arising from the visit to or use of the Website, or related to the acquisition of products or services offered through the Website, the parties submit to the applicable laws of the Mexican Republic and to the jurisdiction of the competent courts of Mexico City, Federal District, expressly renouncing any other jurisdiction that may pertain to them due to their present or future domiciles.
